As an experienced trial attorney and labor negotiator, Travis Gemoets represents management in all facets of labor and employment law, including collective bargaining, prosecution and defense of unfair labor practice claims by and against unions, wage/hour class actions, PAGA representative actions, claims of discrimination, harassment, and wrongful termination, trade secrets and unfair competition, union avoidance, grievance arbitrations, and workplace violence.
A good portion of his client base is the healthcare industry, where he has for almost 30 years represented hospitals, licensed care facilities, other healthcare providers in union negotiations, class action defense, grievances, and arbitration procedures, unfair competition, as well as proceedings before the National Labor Relations Board. He recently succeeded in defeating an injunction action against a healthcare provider in Orange County, California.
He is a member of JMBM's Global Hospitality Group®, in which capacity he negotiates union contracts and resolves labor disputes throughout the country, defends class action claims, develops strategies for the mass onboarding and separation of employees, and recommends proactive changes to employers' policies and practices to minimize potential liability risks. He also advises clients looking to develop, acquire, or sell hotel operations throughout the United States and Puerto Rico.
Travis advises employers nationwide on these areas as well as on disability and religious accommodation, protected absences, workplace violence prevention training, personnel policies and handbooks, employee discipline and discharge, and labor avoidance/labor relations. He frequently lectures and consults in these areas and on other employment-related matters.
Travis has represented employers in hospitals, healthcare, hotels, restaurants, manufacturing, construction, professional services, mining, trucking, petroleum, farm operations, aerospace, home office, and retail, amongst many other industries. He has appeared before federal courts in California, Minnesota, Texas, and Illinois; California state appellate courts and the Ninth Circuit, United States Court of Appeals.
He also has extensive experience with administrative agencies such as the National Labor Relations Board, the Division of Labor Standards Enforcement, the California Civil Rights Division, the Equal Employment Opportunity Commission, and the United States Department of Labor.
