Dan Quinley is a San Francisco-based attorney in the Firm’s Government, Land Use, Environment and Energy Department. Dan represents a range of clients in complex regulatory, permitting, policy, and litigation arenas. Dan has extensive experience with protected species, including permitting, habitat conservation plan development, and litigation, under the federal and California Endangered Species Acts, the Marine Mammal Protection Act, the California Environmental Quality Act, the National Environmental Policy Act, and federal and California Administrative Procedures Acts. He also advises clients on protected species regulatory and policy issues, including state and federal regulatory processes, including species and habitat listing decisions. His practice also emphasizes a deep understanding of water resources, including water rights; municipal, state, and federal water supplies; Indian water law; water transfers and use; groundwater issues; and water quality. He represents mining, construction, and building materials industries, as well as municipal agencies, agricultural interests; trade organizations; energy developers; and agribusinesses.
Dan is admitted to practice before the Ninth Circuit Court of Appeals, the Northern, Central, and Eastern Districts of California, and all California state courts.
Before joining Jeffer Mangels Butler & Mitchell, Dan was in private practice in Sacramento, CA. He also has experience in policy and regulatory affairs with a municipal utility district.
Experience- Represented industry organization on a multi-stakeholder group which involved active risk assessments of industry interactions with protected species, close consultation with California Department of Fish and Wildlife leadership to develop a species conservation plan and state rulemakings, work with scientific experts to quantify and analyze species impacts, and negotiations with environmental non-profit groups.
- Advised multiple clients and developers regarding Endangered Species Act permit planning and application process, including federal and California incidental take permits, habitat listings, multispecies habitat conservation plans, and communications with federal and state resources agencies, including California Department of Fish and Wildlife, United States Fish and Wildlife, and the National Marine Fisheries Service.
- Policy, regulatory, and legislative affairs experience involving protected species management, mitigation, and permitting with a municipal utility district.
