Barbra Arnold has over twenty years of experience representing management in all facets of labor and employment law, including claims of discrimination, harassment, retaliation, wrongful termination, unfair competition, trades secrets matter, labor relations and wage and hour law including litigation of wage and hour class actions relating to failure to pay overtime, and meal and rest period and related claims including PAGA litigation.
Barbra has almost two decades of experience in all aspects of labor relations, including engaging in and overseeing union negotiations, appearing before the National Labor Relations Board ("NLRB") for hearings and administrative trials, handling unfair labor practice charges, providing advice and counsel regarding grievance management, representing management in labor arbitrations, providing training and counseling regarding union avoidance and managing all aspects of union election petitions, including the proper handling of petition, preparing for elections and all related hearings, including the handling of election challenges and objections. Barbra has been the lead negotiator in numerous union negotiations in the healthcare, education, hospitality, and manufacturing industries and routinely negotiates with SEIU-UHW, California Nurses Association, UNAC, SEIU Local 721 and many other unions. Barbra focuses on assisting her clients through union negotiations in an efficient and tailored fashion.
Barbra advises employers nationwide in these areas as well as on disability and religious accommodation, protected leaves of absence, personnel policies, employee handbooks, arbitration agreements, employment contracts, vacation and sick leave requirements, and employee discipline and discharge. She lectures and consults in these areas and on other employment-related matters including providing sexual harassment and wage and hour training to clients.
Barbra has extensive litigation experience, routinely appears in state and federal court and has successfully argued before the California Court of Appeal. She has extensive experience appearing as lead counsel before administrative agencies such as the NLRB, the Division of Labor Standards Enforcement, the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission and the Employment Development Department. She has also served as both lead and co-counsel in numerous NLRB trials and employment law arbitrations.
Amongst other industries, Barbra represents employers in healthcare, hospitality, manufacturing, and defense contracting. Barbra represents both large and small employers and provides a holistic approach to representation focusing on both litigation defense and advice and counseling to avoid future litigation.
